Terms of Service

1. Parties

These terms govern the relationship between Kartial and the individual or legal entity using Kartial's services.

2. Scope of the service

Kartial is a software service used for profit tracking, order and operations analysis, inventory, expense management, reporting and marketplace integrations. Some integrations, modules, limits or features may be in beta, may change or may be discontinued.

3. Account and security

  • The user is responsible for account security and for activity carried out through the account.
  • Sharing credentials with unauthorized persons, pooled use, resale, rental or allowing third parties to operate the account is prohibited.
  • Kartial may limit or suspend an account where there is a security concern, misuse, legal risk or technical necessity.
  • Unauthorized use must be reported without delay.

4. User data and third-party data

  • The user is responsible for the accuracy, legality and timeliness of data entered or imported into the service.
  • If the user imports end-customer or other third-party data, the user remains responsible for the relevant notices, legal basis and usage restrictions applicable to that data.
  • End-customer data visible or processed through Kartial may only be used for order fulfillment, shipping, refunds, reconciliation, accounting and similar legitimate business purposes.
  • The user agrees not to use such data for spam, unauthorized marketing, resale or unlawful disclosure.

5. Marketplace integrations

  • Kartial connects to marketplace services based on the user's own instructions and credentials.
  • The availability, format, rate limits and ongoing operation of marketplace APIs are controlled by the relevant platforms.
  • The user must also comply with the applicable marketplace rules for Trendyol, Hepsiburada, Etsy and any other supported platforms.
  • Marketplace names, logos and trademarks are used only for identification and do not imply endorsement, partnership or certification unless expressly stated.

6. Prohibited uses

  • Kartial may not be used for unlawful sales, tax or accounting manipulation, misleading reporting, spam, unauthorized data extraction or off-purpose use of third-party data.
  • Scraping, abusive automation, reverse engineering, unauthorized security testing or excessive use intended to bypass limits is prohibited.
  • The user agrees to use data obtained through Kartial only for legitimate business purposes and in compliance with applicable law.

7. Fees, plans and promotions

  • Kartial may change, discontinue or withdraw prices, plans, limits, promotions, beta advantages and feature scope in accordance with applicable law and these terms.
  • Any pricing, promotion or early-access language shown on landing pages or promotional materials is for marketing purposes unless expressly stated as a binding contractual commitment.
  • If a paid subscription is active, material price or plan changes will, where practicable, be notified at least 14 days before taking effect and will generally apply at renewal, subject to mandatory law.
  • If the user does not accept the updated terms, the user may choose not to renew or may terminate the account before the change becomes effective.

8. No professional advice

Calculations, reports, tax outputs, margin figures, commission estimates and similar outputs provided by Kartial are for informational convenience only and do not replace accounting, tax, legal or financial advice.

9. Disclaimer of warranties

  • To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis.
  • Kartial aims to apply reasonable technical and organizational measures in operating the service, but does not guarantee uninterrupted availability, absolute data integrity or data recovery in every case.
  • Kartial does not warrant uninterrupted operation, error-free service, data completeness, fitness for a particular purpose or any specific commercial result.
  • Third-party infrastructure, marketplace APIs and user-supplied data may affect the service in ways outside Kartial's control.
  • Unless expressly committed in writing, the service does not include a dedicated backup, archival, disaster recovery or uptime/SLA commitment for the user's own retention needs.

10. Limitation of liability

  • The user remains responsible for business decisions based on imported data, delayed sync, API changes, rate limits, tax interpretations, pricing decisions or operational actions.
  • To the maximum extent permitted by law, Kartial does not accept liability for lost profits, lost revenue, data loss, reputational harm, tax penalties, indirect damages, incidental damages, consequential damages or special damages.
  • Except for non-waivable liabilities, intentional misconduct and gross negligence, Kartial's total liability is limited to the total amount actually paid by the user to Kartial during the 12 months preceding the event giving rise to the claim.

11. Intellectual property

  • Kartial's brand, interface, design, code and content belong to Kartial or the relevant rights holders.
  • User data belongs to the user, but the user grants Kartial the rights necessary to process that data for operation of the service.

12. Deletion, data access and termination

  • The user may delete the account from within the application or by contacting destek@kartial.com.
  • The user is responsible for exporting or preserving records needed for its own operations before deletion or termination; access to data may end after closure.
  • Kartial does not undertake to provide data export in any specific format, although reasonable support may be offered where technically feasible.
  • Even after termination, certain records may be retained for security, logging, dispute handling, legal retention or evidentiary purposes for the applicable period.
  • Kartial may restrict, suspend or terminate the service for breach, misuse, legal risk or security reasons.

13. Force majeure

Kartial is not liable for delay, interruption or non-performance caused by events beyond its reasonable control, including earthquakes, fire, war, terrorism, widespread internet or power outages, cloud infrastructure failures, cyberattacks or actions of public authorities.

14. Governing law

These terms are governed by the laws of the Republic of Turkiye. Subject to mandatory law, the courts and enforcement offices of Ankara have jurisdiction.

15. Updates

Kartial may update these terms in line with legal, product or operational changes. The current version is published on this page and, where appropriate, advance notice may be given for material changes.
